1. Acceptance of Terms
By accessing or using Ease (the "Application", "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not use the Application.
These Terms constitute a legally binding agreement between you ("you", "your") and Ease Health ("we", "us", "our", "Ease Health"). The Application is designed for migraine tracking and wellness monitoring by individual consumers. It is not intended for use by healthcare professionals or clinical settings.
By creating an account, you confirm that you are at least 16 years of age. If you are under 16, you must have the consent of a parent or legal guardian to use the Application.
2. Acceptable Use
You agree to use the Application only for its intended purpose: personal migraine and wellness tracking. You must not:
- Use the Application in any way that violates applicable law or regulation.
- Attempt to gain unauthorised access to any part of the Application, our infrastructure, or any other user's account.
- Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code of the Application.
- Use the Application to upload or distribute any content that is false, misleading, defamatory, obscene, or offensive.
- Interfere with or disrupt the integrity or performance of the Application or any data contained within it.
- Use automated tools, bots, or scrapers to extract data from the Application without our express written permission.
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
- Resell, sublicense, or commercially exploit any part of the Application without our prior written consent.
We reserve the right to suspend or terminate your access to the Application if you breach these acceptable use requirements.
3. Medical Disclaimer
Important — Not a Medical Device
Ease is a wellness and migraine tracking application. It is not a medical device as defined by the U.S. Food and Drug Administration (FDA), the European Medical Device Regulation (MDR 2017/745), or any other applicable regulatory framework. Ease does not diagnose, treat, cure, or prevent any disease, condition, or symptom.
3.1 No Medical Advice
The content provided through Ease — including any insights, trigger correlations, risk scores, or other information — does not constitute medical advice. Ease is not intended to be a substitute for professional medical diagnosis, treatment, or advice. Always seek the advice of your physician, neurologist, or other qualified healthcare provider with any questions you may have regarding a medical condition.
3.2 Not a Substitute for Medical Care
Never disregard professional medical advice or delay in seeking it because of something you have recorded in or learned from Ease. If you believe you are experiencing a medical emergency, call your local emergency services immediately.
3.3 Clinical Features and FDA 510(k)
Ease's current features are provided as a consumer wellness application. Future features planned for clinical validation — including the predictive migraine risk scoring system (Phase 2–4 of the roadmap) — are not yet validated or cleared by the FDA or any other regulatory body. The 510(k) submission referenced in our roadmap is a future goal, not a current status. Until such time as Ease or any successor product receives appropriate regulatory clearance, it must not be used as a clinical decision-making tool.
3.4 User Responsibility
You acknowledge that migraine is a serious medical condition and that tracking your attacks through Ease is one component of managing your health. You are solely responsible for:
- Consulting with your healthcare provider about any treatment decisions
- Interpreting Ease data in consultation with qualified medical professionals
- Ensuring that any medications, supplements, or lifestyle changes you make are discussed with your healthcare provider
4. Account Termination
4.1 Termination by You
You may delete your account and stop using Ease at any time through the app settings or by contacting us at [email protected]. Deletion of your account is subject to our Privacy Policy data retention terms.
4.2 Termination by Ease Health
We may suspend or terminate your account, with or without notice, if:
- You breach these Terms of Use or our Acceptable Use policy (Section 2)
- You use Ease in a manner that we reasonably believe poses a safety risk to yourself or others
- You engage in fraudulent activity or misrepresent your health information in a way that undermines the integrity of the service
- We are required to do so by law, regulation, or court order
- We discontinue the Application (we will provide reasonable notice where practicable)
4.3 Effect of Termination
Upon termination of your account:
- Your right to access the Application immediately ceases
- Your personal data will be handled in accordance with our Privacy Policy, including permanent deletion within 30 days of your deletion request
- Any outstanding fees (if applicable in the future) remain payable
- Provisions of these Terms that by their nature should survive termination (including Medical Disclaimer, Limitation of Liability, and Indemnification) shall survive
5. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Application, legal requirements, or business practices. If we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Notify you via email or prominent in-app notice at least 30 days before the changes take effect
- Obtain your explicit consent for changes that expand our data collection or processing in new ways
Continued use of the Application after changes take effect constitutes your acceptance of the revised Terms.
